I represent that all statements contained herein are true and correct and that I have read, understand and agree to the terms and conditions as outlined on this page and in the box below.
RULES
1. The use of any illegal drug related substances will not be tolerated at
any time. 2. Athletes (regardless of age) are not permitted to consume alcohol.
For adult supporters/chaperones, alcohol and tobacco will not be used around the athletes
at any time. 3. No male athletes are permitted in female athletes' rooms and
vice versa. 4. All participants will be responsible for any damage that may
occur in their hotel rooms and/or other areas while on tour. 3. Any additional
cost incurred, not included in the stated tour will be the participants
responsibility. All bills must be paid before leaving each location. 4. Each
participant agrees to follow ISSI rules as set forth in this document and all
rules outlined by ISSI staff while on the trip. Failure to comply with any rules
could result in possible early return to point of original departure at
participant's own expense. No refunds or partial refunds will be allowed if the
participant's travel is terminated early.
TOUR RATES - The
tour cost is based upon rules, regulations, fares, prices and US dollar exchange
rates in effect on June 1st of the previous year and are subject to change if
such rates or costs increase. The tour cost is also subject to increases due to
unforeseen fuel surcharges and government taxes. We will notify you of any
changes in the cost of the tour.
AIR TRANSPORTATION – If the participant opts
for ISSI to purchase their domestic airfare, the airport will be designated by
ISSI. Participants will be responsible for transportation to and from their home
to the designated airport. Participants will be booked with coaches and/or
athletes whenever possible; however there may be an occasion where a participant
may travel to or from LAX/SFO alone.
OWN DOMESTIC WAIVER - If a participant
chooses to arrange their own transport to/from LAX/SFO, ISSI's responsibility
for such participant will begin/end in LAX/SFO. Participant will assume all
responsibility of arriving for the scheduled International flight with the
necessary connection time. Requests to arrange own domestic flights or requests
for any deviation from the scheduled itinerary must be in writing and sent to
ISSI by April 1st, 2012. All deviations will result in a $250 deviation fee plus any
additional cost in airfare. ISSI cannot confirm final travel dates until April
15, 2012. ISSI is not be responsible if participant purchases domestic tickets
for the wrong date/time, and any fees incurred for this purpose shall be the
sole responsibility of the participant.
GROUND TRANSPORTATION & TRANSFERS - All ground
transportation will be provided by modern climate controlled motor coaches. All
transfers for the tour events are included. It is the responsibility of each
participant to find transportation to and from their airport of origination. All
airport and hotel transfers are included unless otherwise specified.
ACCOMMODATIONS - Accommodations are at the hotels listed in the itineraries. If
a change becomes necessary for any reason, hotels substituted will be equivalent
to those listed. Single Rooms. A limited number of single rooms are available to
supporters/chaperones at a supplemented price of $450 for Australia only and $600 for
Australia and Hawaii. Share Room. All supporters/chaperones are roomed in double occupancy
rooms unless a single room supplement has been purchased or other arrangements
have been made through ISSI. All athletes are generally roomed in triple
occupancy rooms. Each athlete will have their own bed. MEALS - Two meals per day
throughout the tour will be provided beginning with the arrival in the host
country, or the morning after arrival in Hawaii (if going to Hawaii first) and
ending upon arrival in the United States.
TIPS & TAXES - Taxes, such as
International airport & airline taxes, and tips including restaurant, porters,
bellmen, etc. are included.
TOUR ESCORTS - In addition to the Coaches, tour
escorts (generally native New Zealanders or Australians) accompany each group
while Down Under.
DEPARTURE DATES - School holidays and other considerations
will be used to allocate departure dates for each group. You will be notified of
your group's departure date.
ITINERARY CHANGES - ISSI's Down Under Sports
program is planned a year in advance. Between planning time and the actual tour
operation, constant efforts are made to improve each itinerary and all features
for your advantage, convenience and enjoyment. If improvements can be made or
unforeseen conditions beyond our control deem necessary changes, we reserve the
right to vary itineraries, and substitute the best alternative feature
available.
FUNDRAISING - All monies fundraised must be submitted to ISSI monthly.
No fundraiser money is allowed to be kept by the athlete.
INSURANCE - In order to travel with the Down Under Sports program, each
participant MUST have health and accident insurance that will cover them for
international medical expenses. If your insurance does not cover you internationally
OR you do not have insurance you must purchase the Basic Travel Protection Plan for $199.
This plan can be purchased any time prior to departure. It is not intended to replace full
coverage, major medical health insurance policies. Participants using the Basic
Travel Protection Plan as a secondary policy to their own existing health and
accident insurance must provide their primary insurance details to ISSI prior to
travel. If you do not purchase the cancel for any reason insurance policy you will
be automatically billed for the Basic Travel Protection Plan. You have the option
to decline this plan provided you are covered by your own international medical
plan and submit those details prior to travel.
INSURANCE ONLY AVAILABLE FOR PURCHASE WITHIN 14 DAYS OF DEPOSIT
Coverage becomes effective upon receipt of $199 insurance payment.
PERSONAL ITEMS -
Not included are personal items such as additional food or beverage orders, room
service, valet laundry service, telephone charges, optional activities, and any
other items not specifically mentioned as being included in the itinerary. Any
additional hotel charges will need to be paid when checking out of the hotel.
Any excess or overweight baggage charges are not included. Charges for
transporting poles for pole vaulters are not included and will be the
responsibility of participant.
PASSPORT AND ELECTRONIC TRAVEL AUTHORIZATION
(ETA) - The cost of obtaining a passport is not included. Contact your local
Post Office or County Clerk's office to obtain the necessary forms for your
passport. ETA (Electronic Travel Authorization) in most cases replaces the need
for a visa. ISSI must be provided with a copy of the front page of the passport
(the page with the picture on it) at least 30 days prior to departure in order
to obtain the ETA. In some cases, ISSI is not able to obtain an ETA for non-U.S.
Citizen participants. In such case, the participant is responsible for obtaining
their own ETA through the Australian Embassy. Failure on the participant's part
to timely secure a proper passport and ETA could result in the participant not
being able to travel. ISSI cannot return payment for the trip for such failures.
SECURITY - As with all travel, especially to foreign destinations, there is a
degree of risk of loss associated with the proper care of valuables. Each
participant needs to be extremely cautious to assure that personal items, money,
and other valuables are properly cared for. ISSI will not be responsible for
theft and other losses.
BAGGAGE - Participants are at all times responsible for
handling their own luggage. Luggage will be limited to two checked pieces and
one carry-on piece. Checked luggage cannot exceed 50 pounds. Certain airlines
may charge fees for baggage, if these fees occur they are the responsibility of
the participant.
DEPOSITS AND PAYMENTS - Application forms sent to ISSI will be
considered on a first-come first-serve basis. Each application must be
accompanied by the required $300 deposit. The deposit is non-refundable and
non-transferable (Exception: non-accepted applicants and cancellations within
three days of receipt of application are entitled to a full refund). The deposit
will be applied 100% to the trip cost. Payments are required according to the
payment schedule. The program office reserves the right to refuse admittance or
remove a participant from the program for any reason whatsoever, with or without
cause. If the program office refuses acceptance of a participant or removes a
participant prior to departure, the sole liability of the program is to refund
any monies paid to the program. If the program office removes a participant for
non-payment of scheduled installments, administrative charges will be assessed
as shown in our cancellation and refund policy. Late fees may be incurred if
payment and final balance are received after the due dates. If a participant is
removed or cancels his or her participation after departure, no refund will be
made, and the participant will be liable for all additional travel expenses
incurred.
CANCELLATIONS/REFUNDS - All cancellations and any associated refund
requests must be made in writing to ISSI. Cancellations may also be faxed to
(435) 792-3046.
• Deposit of $300 is non-refundable and non-transferable at any
time.
• If the basic travel protection plan and/or cancel for any reason insurance has
been purchased the premium paid is non-refundable
• Cancellations received by ISSI less than 95 days from the scheduled departure
date will result in an additional $1000 to be kept by ISSI.
• Cancellations received by ISSI less than 70 days from the scheduled departure
date will result in an additional $1000 to be kept by ISSI.
• All monies are non-refundable and non-transferable if
notification of cancellation is received less than 45 days prior to the
scheduled departure date.

RESPONSIBILITY DISCLAIMER - International Sports Specialists, Inc. (ISSI) is a
Utah corporation. ISSI is acting as an intermediary or an agent for suppliers in
selling services or in accepting reservations of bookings for services which are
not directly supplied by ISSI (such as all carriage, hotel accommodations,
ground transportation, meals, tours, cruises, etc.) ISSI therefore, shall not be
responsible for breach of contract or any intentional or careless actions or
omissions on the part of such suppliers, which result in any loss, damage,
delay, or injury to you or your travel companions or group members. Unless the
term guaranteed is specially stated in writing on your ticket, invoice or
reservation itinerary, we do not guarantee any of such supplier's rates,
bookings, or reservations. Your retention of tickets, reservations or bookings
after issuance shall constitute consent to the above, and an agreement on your
part to convey the contents herein to your travel companions or group members.
ISSI herein gives notice that it cannot be held responsible for any disruptions
of travel and/or related services in troubled areas, due to monetary crisis,
political or social unrest, labor problems, mechanical or construction
difficulties, climatic aberrations, local laws, diseases, or novel conditions,
including terrorism. By signing the application form the participant represents
to ISSI that they have no health problems, behavior disabilities, or other
medical or other limitations that could restrict or substantially interfere with
their own or other participant's ability to fully participate in the program.
Furthermore, all medical needs, regular treatments, or needs are the sole
responsibility of the participant. The cost of any special needs of the
participant will be their responsibility.
MEDICAL RELEASE - In the event of an accident or injury, ISSI will
make a reasonable attempt to contact the party named on this form at the phone
number listed for such individual. Should an ISSI representative be unable to reach this
person, ISSI is hereby authorized to seek the best medical attention possible
and is empowered to make medical care decisions as recommended by the medical
profession. ISSI will often extend payment to foreign medical providers as a
courtesy to its participants. Should ISSI extend such good faith coverage of
medical cost the participant agrees to work with ISSI and/or the insurance
company to ensure all prepaid medical expenses are reimbursed directly to ISSI.
The contents of food cannot be controlled while on tour. Special dietary needs
are the responsibility of the program participant.
ELIGIBILITY STATEMENT – The
signers of this form certify that the athlete listed is a qualified athlete in
their chosen sport, or an experienced cheerleader/dancer that will be mature
enough to fully appreciate a trip of this nature. We furthermore certify that if
the athlete participant is an underclassman, we have taken the proper steps
necessary to assure that participation in the Down Under Sports Program will not
restrict participation in sports for the balance of the participant's high
school years. We acknowledge that athletic competitions are physically demanding
activities and could result in physical injury and that participation is on a
voluntary basis. We therefore release ISSI, all coaches, staff, and all other
parties associated with this program from any liability and hold them harmless
against any and all injuries that might arise from participation in this
program.
RELEASE INFORMATION - The applicant signature on this application
indicates permission for ISSI, and those acting pursuant to its authority to
record the applicant's participation and appearance on video tape, audio tape,
film, photograph, or any other medium and to use the applicant's name, likeness,
voice, comments, submitted documentation, written papers, and/or biographical
material without restrictions or limitation for any educational or promotional
purpose which ISSI and those acting pursuant to its authority deem appropriate,
unless a participant indicates in writing otherwise.
GOVERNING LAW, JURISDICTION
AND VENUE - This agreement, and all matters relating hereto, including any
matter or dispute arising out of the agreement, shall be interpreted, governed,
and enforced according to the laws of the State of Utah. In the event that
either party makes a claim against the other relating to any alleged act, error,
or omission of the other party in connection with the ISSI Down Under or any
related activities, some of which will occur in a foreign country, the parties
hereby stipulate and agree and irrevocably consent to jurisdiction and venue in
any resulting legal action as the appropriate State or Federal Court in the
State of Utah. ISSI is registered as a "Seller of Travel" with the Attorney
General's of California (#2067927-40), Washington (#602207085), and Hawaii
(TAR-6164). Registration as a seller of travel does not constitute approval by
the various states.
INTELLECTUAL PROPERTY PERMISSION - By attending this event,
you consent to the use of your photograph, voice, likeness, and image in
broadcasts of this event and in subsequent productions drawn from video or audio
recordings of this event.
